Elon Musk Questions Penalty Against German Politician Over Controversial Social Media Post
Tesla and SpaceX CEO Elon Musk has raised questions about a penalty imposed on a German politician who was found guilty of inciting hatred by repeating accurate government statistics.
The guilty party is Marie-Thérèse Kaiser, leader of the Rotenburg AfD. The verdict against her by Verden regional court in Lower Saxony included 100 day fines plus an additional fine of €60, amounting to a total of €6,000. This verdict places her on a criminal record in Germany as the payment threshold is at 90 day fines.
The incrimination comes from a social media post by Kaiser in August 2021. Here, the politician made statements linking Afghan refugees to gang rapes in Germany, sparking outrage.
The verdict eventually drew the attention of Elon Musk, who expressed doubt about the justification of the punishment for stating what he considered to be accurate government statistics.
Politician Raises Alarm Over Gang Rape
Following the announcement by Peter Tschentscher, Hamburg's First Mayor, to accept 200 Afghan local workers, Kaiser voiced concerns about uncontrolled immigration. She justified this fear using statistical data about rapes allegedly committed by "culturally alien masses". In Kaiser’s words, she refused to remain silent at the risk of being criminalized for stating numbers, data, and facts.
Court's Verdict Challenged
At the hearing, Judge Heiko Halbfas defended the court's decision, stating that attacks on human dignity cannot be justified by free speech. He accused Kaiser of deliberately creating an image that incites hatred against a nationally determined group.
Kaiser voiced her disappointment with the ruling and her intent to appeal. She disclosed receiving overwhelming support and press inquiries, with increasing demands for a donation platform to assist her cause.
