Fulton County District Attorney Fani Willis has approached the Georgia Court of Appeals, seeking the reinstatement of six racketeering charges against former President Donald Trump. Willis had previously leveled three counts of solicitation against Trump, accusing him of soliciting Georgia House Speaker David Ralston and Georgia Secretary of State Brad Raffensperger to alter the outcomes of the 2020 election.
Charges against Trump's Associates
Willis also filed similar charges against Rudy Giuliani, Trump's former lawyer, and his former chief of staff, Mark Meadows. However, Superior Court Judge Scott McAfee dismissed these charges against all defendants, stating that they had not been given sufficient detail to prepare an adequate defense. McAfee also dismissed three other charges against Trump, citing that they fell outside Willis's jurisdiction.
Willis's Argument
Willis's office argued in a recent filing that McAfee made an error by quashing six counts of the indictment, each of which alleged the crime of Solicitation of Violation of Oath by Public Office. Willis contended that the state does not need to provide specific details regarding the target crime of violation of oath by public officer, as these details are not necessary for a charge of solicitation of violation of oath by public officer.
Trump's Defense
Steve Sadow, Trump's lead attorney in the case, dismissed Willis's request, stating it was "simply incorrect on the law".
Case Paused
The case against Trump has been on hold since June while the Georgia Court of Appeals deliberates on whether to disqualify Willis from the case entirely due to her inappropriate relationship with former special prosecutor Nathan Wade. Wade testified before the House Judiciary Committee, insisting that the case against Trump was not politically motivated and that his romantic relationship with Willis did not compromise the case's integrity. Oral arguments on whether Willis can remain on the case are scheduled for Dec. 5.
